Discrimination Legislation

Legislation on discrimination covers both discrimination in the provision of goods, services and facilities, and discrimination in employment. Previous legislation is now consolidated into The Equality Act 2010. More information about discrimination in employment is contained in the members section of the FPM website.

Discrimination in the provision of goods, services and facilities to the public requires that providers of goods, services and facilities do not discriminate:

Definitions

Direct discrimination occurs where a service provider carries out a particular act on the grounds that a person possesses a certain characteristic, for example not providing a service (or providing a lesser service) to a person because he/she is disabled or from an ethnic background.

Indirect Discrimination occurs where a provision, criterion or practice is applied which, although applied equally to others, has the effect of disadvantaging a particular group, for example disabled people, or those of a particular race or sex.

Harassment is commonly described as subjecting another person, on grounds of his/her sex, race, ethnic origin, sexual orientation, gender reassignment religion or belief, or disability to unwanted conduct, which has the purpose or effect of violating his or her dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment.
