This week’s policy update for FPM members includes a brand new document, the Drugs, Alcohol and Legal High Misuse Policy. We also have significant updates to our documents relating to Drugs (Non-Controlled) and Vaccines Storage Protocol and Premises Standards.

The Drug Misuse Policy and Alcohol Misuse Policy have been combined and updated to include references to the recently introduced Psychoactive Substances Act 2016, which came into effect last year. Here’s some of the key information about the act:

  • Introduced in May 2016 covering the whole of the UK, it is intended to restrict the production, sale and supply of a new class of psychoactive substances often referred to as "legal highs"
  • The law defines a "psychoactive substance" as anything which "by stimulating or depressing the person’s central nervous system, affects the person’s mental functioning or emotional state"
  • The law bans all such substances but excludes alcohol, tobacco or nicotine-based products, caffeine, food and drink and medicinal products covered by other legislation and any drug that is already regulated under the Misuse of Drugs Act 1971
  • The Act makes it an offence to produce, supply, offer to supply, possess with intent to supply, possess on custodial premises, import or export psychoactive substances; that is, any substance intended for human consumption that is capable of producing a psychoactive effect

Originally it was thought that the law could be applied so broadly as to include the sale of toads and salamanders that naturally produce psychoactive substances.  However these concerns proved unfounded and you will be relieved to know that no psychoactive amphibians were confiscated!
