Legislation Update: Children and Families Act 2014

From 1st October 2014 employees and agency workers will have a new right to take time off work to attend up to 2 ante-natal appointments.

The right is for those in a ‘qualifying relationship’ to take unpaid time off work to attend up to two appointments, for a maximum period of six and a half hours for each appointment. There is no qualifying minimum length of service required. Those in a ‘qualifying relationship’ are the pregnant woman’s husband, civil partner or partner, the father or parent of the pregnant woman’s child who meet the specified conditions.

An employer can require an employee or agency worker to make a declaration stating that he or she has a qualifying relationship with a pregnant woman or her expected child and that he or she is taking the time off to attend the ante natal appointment along with the date and the time.

The Act also provides for paid and unpaid time off work for adopters to attend meetings in advance of a child being placed with them for adoption – but this is not expected to be in force until after October this year.
