Age Discrimination and Employment Law

Some of you will have met me at the Agenda for Change workshops which I delivered through FPM around the UK in 2006. You will know that I am an HR specialist/consultant, trainer and facilitator in General Practice. I have now designed a workshop for practice managers/GPs about the implications of the Age Discrimination legislation which was introduced in October 2006.

This legislation affects all businesses, no matter what size, and even has an impact on partnerships. Practices cannot just ignore this legislation because you must take a number of active measures, e.g. for employees who retire, to avoid discrimination and claims for unfair dismissal.

The legislation covers all workers, employees and job seekers and is designed to eliminate discrimination of anyone – both older and younger - on the grounds of their age. It covers direct and indirect discrimination and its implications are far-reaching. It affects recruitment, selection, employment policies, rewards, training opportunities, redundancies and retirements.

There are many implications for the practice manager and GPs to consider and action which must be undertaken in each practice. Failure to do so, may leave the practice open to claims for unfair dismissal or discrimination (which will have no financial ceiling). Many employers fail to recognise the implications of discrimination in the workplace, although successful claims are uncapped and average awards for discrimination have consistently are higher than those for unfair dismissal. Practices often assume that a discrimination claim would be unlikely but a disgruntled employee who takes advice can all too easily pinpoint a potential area of discrimination.

To help practice managers and GPs understand the legislation and take all the relevant action, I have prepared a workshop which is tailor-made for general practice and includes case studies and scenarios.

Half-Day Discrimination Workshop

This half-day workshop can be booked direct by a group of practice managers, perhaps via a practice managers’ forum or via the PCO. The workshop clarifies the different elements of the age discrimination legislation and explores the implications for the practice. It also includes an update on the other areas of discrimination such as disability, sex, race, sexual orientation, religion or belief.

Full-Day Discrimination, Grievance and Disciplinary Workshop

This full day workshop can also be booked direct by a group of managers and covers age and other discrimination, as well as an update on grievance and disciplinary procedures. The workshop provides a refresher regarding the statutory procedures introduced in 2004, together with the implications of some recent cases.
